Protection From Discrimination in Boca Raton, Florida
You would like to believe that if you work hard and perform your duties diligently, your employer would treat you with respect and reward your loyalty. Unfortunately, some employment decisions are not based on your work history, but on factors that are irrelevant to your ability to do the job, such as your age or gender.
At Backer Law Firm, P.A., in Boca Raton, Florida, we advocate for individuals who are being treated unfairly in the workplace for any reason, including age, gender or pregnancy.
If you feel you are being treated differently than other employees in your company because of your age, gender or pregnancy, or for any other reason, contact us to discuss your matter in a confidential consultation.
We understand how important steady employment is in the current economy, and recognize how the loss of one's job can devastate you personally, professionally and financially.
Can They Really Let Me Go for That Reason?
Florida is an employment-at-will state. Your employer can terminate your employment at any time for a variety of reasons, just as you can quit at any time without consequences. However, the law provides that employees cannot be terminated for certain excluded reasons, including:
- Age: Individuals over the age of 40 cannot be harassed or terminated based solely on their age under the Age Discrimination Employment Act of 1967.
- Pregnancy: You cannot be denied a job, terminated or forced to take time off simply because you are pregnant. Under The Family and Medical Leave Act (FMLA), if you must take time off due to your pregnancy, your employer must treat you as they would if you had a temporary disability.
Freedom From Gender Harassment
Your employer has no right to treat you differently just because of your gender or because you do not fit their particular mold of a woman or a man. Men and women must be treated equally, and you cannot be harassed or discriminated against because you look or act in a way that is considered "too different" from other members of your gender. For example, you do not need to endure unfair treatment because you are considered too effeminate, flamboyant or butch in appearance or mannerism. We are a strong advocate for the gay, lesbian, bisexual and transgender (GLBT) community.
